DECISION OF THE EEA JOINT COMMITTEE No 161/2025

amending Annex XIII (Transport) to the EEA Agreement [2025/1818]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2023/1770 of 12 September 2023 laying down provisions on aircraft equipment required for the use of the Single European Sky airspace and operating rules related to the use of the Single European Sky airspace and repealing Regulation (EC) No 29/2009 and Implementing Regulations (EU) No 1206/2011, (EU) No 1207/2011 and (EU) No 1079/2012 ( 1 ) is to be incorporated into the EEA Agreement.

(2) Implementing Regulation (EU) 2023/1770 repeals Commission Regulation (EC) No 29/2009 ( 2 ) and Commission Implementing Regulations (EU) No 1206/2011 ( 3 ) , (EU) No 1207/2011 ( 4 ) and (EU) No 1079/2012 ( 5 ) , which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(3) Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XIII to the EEA Agreement is amended as follows:

The following point is inserted after point 66wo (deleted):

‘66wp.

32023 R 1770 : Commission Implementing Regulation (EU) 2023/1770 of 12 September 2023 laying down provisions on aircraft equipment required for the use of the Single European Sky airspace and operating rules related to the use of the Single European Sky airspace and repealing Regulation (EC) No 29/2009 and Implementing Regulations (EU) No 1206/2011, (EU) No 1207/2011 and (EU) No 1079/2012 ( OJ L 228, 15.9.2023, p. 39 ).

The provisions of the Implementing Regulation shall, for the purposes of this Agreement, be read with the following adaptation:

In section AUR.COM.2001 of Title 1 of Annex 1, the words “, Polaris Flight Information Region (FIR) north of 61°30′” shall be inserted after the words “Finland Upper Flight Information Region (UIR) north of 61°30′”.’

The texts of points 66we (Commission Implementing Regulation (EU) No 1079/2012), 66wg (Commission Regulation (EC) No 29/2009), 66wj (Commission Implementing Regulation (EU) No 1206/2011) and 66wl (Commission Implementing Regulation (EU) No 1207/2011) are deleted.

Article 2

The text of Implementing Regulation (EU) 2023/1770 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 14 June 2025, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
