approving the listing of ports in accordance with Chapter II of Implementing Regulation (EU) 2024/1474
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1224/2009 of 20 November 2009 establishing a Union control system for ensuring compliance with the rules of the common fisheries policy amending Regulations (EC) No 847/96, (EC) No 2371/2002, (EC) No 811/2004, (EC) No 768/2005, (EC) No 2115/2005, (EC) No 2166/2005, (EC) No 388/2006, (EC) No 509/2007, (EC) No 676/2007, (EC) No 1098/2007, (EC) No 1300/2008, (EC) No 1342/2008, and repealing Regulations (EEC) No 2847/93, (EC) No 1627/94 and (EC) No 1966/2006 (1), and in particular Article 14(6) thereof,
Whereas:
(1) Article 14(3) of Regulation (EC) No 1224/2009 provides for rules and measures on the permitted margin of tolerance in estimates recorded in the fishing logbook of quantities in kilograms of fish retained on board of fishing vessels.
(2) In order to address the challenges of accurately estimating catches on board by species, Article 14(4), point (a), of Regulation (EC) No 1224/2009, as amended by Regulation (EU) 2023/2842 of the European Parliament and of the Council (2), provides for a derogation from the existing margin of tolerance that may be granted for unsorted landings from small pelagic fisheries, industrial fisheries, and tropical tuna purse seine fisheries. The same derogation applies to estimates recorded in the transhipment declaration, in accordance with Article 21(3) of that Regulation.
(3) Such derogation may only be granted if the species caught in those fisheries are landed or transhipped in listed ports and subject to additional conditions for masters of Union fishing vessels, coastal Member States and flag Member States laid down in Chapter IV of Commission Implementing Regulation (EU) 2024/1474 (3).
(4) For the listing of ports, the ports are to comply with the conditions set out in Chapter II of Implementing Regulation (EU) 2024/1474 and approved by the Commission in accordance with the procedure laid down in Chapter III of that Regulation.
(5) Denmark submitted an application to the Commission to include six ports located in its territory, namely the ports of Skagen, Thyborøn, Hirtshals, Grenå, Hvide Sande and Hanstholm, in the list of ports approved by the Commission, in accordance with Article 6 of Implementing Regulation (EU) 2024/1474.
(6) Latvia submitted an application to the Commission to include one port located in its territory, namely the port of Ventspils, in the list of ports to be approved by the Commission, in accordance with Article 6 of Implementing Regulation (EU) 2024/1474.
(7) Based on the information and evidence submitted by Denmark and Latvia in their applications, the Commission found that the conditions set out in Chapter II of Implementing Regulation (EU) 2024/1474 for each port proposed to be listed have been fulfilled, following an assessment carried out by the Commission as referred to in Article 7(1) of that Regulation.
(8) According to the information submitted by Denmark, the ports of Skagen, Thyborøn, Hirtshals, Grenå, Hvide Sande and Hanstholm meet the conditions required under Articles 2 and 3 of Implementing Regulation (EU) 2024/1474 for the listing of ports within the Union. The ports have in place procedures to ensure the accurate weighing of all catches. Specifically, these ports are equipped with remote electronic monitoring systems with closed-circuit television (CCTV) cameras, weighbridges and hopper scales, semi-automated sampling chute directly connected to the water separators, and independent third-party weighers that meet the minimum requirements set out in Article 3(3) of Implementing Regulation (EU) 2024/1474. Moreover, the requirements for accurate weighing are further supported by the sampling and control plans approved by the Commission for the ports of Skagen, Thyborøn, Hirtshals, Grenå, Hvide Sande and Hanstholm, which have been implemented by Denmark under National Order No 1765 of 03/09/2021.
(9) According to the information submitted by Latvia, the port of Ventspils meets the conditions required under Articles 2 and 3 of Implementing Regulation (EU) 2024/1474 for the listing of ports within the Union. The port has in place procedures to ensure the accurate weighing of all catches. Specifically, this port is equipped with remote electronic monitoring system with CCTV cameras, pallet weighing scales, as well as a semi-automated sampling chute directly connected to the water separator and natural or legal persons authorised by the competent authorities of the coastal Member State which fully monitor the accuracy of the weighing of each landing and transhipment of catches. Moreover, the requirements for accurate weighing are further supported by the sampling plan approved by the Commission which has been implemented by Latvia under the National Regulations No 94.
(10) Based on the information submitted, the ports proposed to be listed by Denmark and Latvia should therefore be approved and entered in the list of ports referred to in Article 14(6) of Regulation (EC) No 1224/2009,
HAS ADOPTED THIS REGULATION:
Article 1
Approval of the listing of ports
The Commission approves the ports which comply with the relevant provisions of Chapter II of Implementing Regulation (EU) 2024/1474 listed in the Annex to this Regulation.
Article 2
Entry into force
This Regulation shall enter into force on the day following that of its publication in the
Official Journal of the European Union
.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
