DECISION OF THE EEA JOINT COMMITTEE No 88/2025

amending Annex XIII (Transport) to the EEA Agreement [2025/977]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2023/1694 of 10 August 2023 amending Regulations (EU) No 321/2013, (EU) No 1299/2014, (EU) No 1300/2014, (EU) No 1301/2014, (EU) No 1302/2014, (EU) No 1304/2014 and Implementing Regulation (EU) 2019/777 ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2023/1695 of 10 August 2023 on the technical specification for interoperability relating to the control-command and signalling subsystems of the rail system in the European Union and repealing Regulation (EU) 2016/919 ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2023/1696 of 10 August 2023 amending Implementing Decision 2011/665/EU as regards the specification for the European register of authorised types of vehicles referred to in Article 48 of Directive (EU) 2016/797 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XIII to the EEA Agreement shall be amended as follows:

Point 37ai (Commission Regulation (EU) No 1304/2014) is amended as follows:

(i) the following indent is added:

‘—

32023 R 1694 : Commission Implementing Regulation (EU) 2023/1694 of 10 August 2023 ( OJ L 222, 8.9.2023, p. 88 ).’;

(ii) adaptation (b) is deleted; adaptations (c) and (d) are renumbered as adaptations (b) and (c).

The following indent is added in point 37dk (Commission Implementing Decision 2011/665/EU):

‘—

32023 D 1696 : Commission Implementing Decision (EU) 2023/1696 of 10 August 2023 ( OJ L 222, 8.9.2023, p. 561 ).’.

Point 37do (Commission Regulation (EU) No 1302/2014) is amended as follows:

(i) the following indent is added:

‘—

32023 R 1694 : Commission Implementing Regulation (EU) 2023/1694 of 10 August 2023 ( OJ L 222, 8.9.2023, p. 88 ).’;

(ii) adaptation (a) is deleted;

(iii) adaptations (b) to (e) are renumbered as adaptations (a) to (d);

(iv) in adaptations (b) and (c) the classification “(‘T’)” as regards the Specific case Norway shall be replaced by the classification “(‘T2’)”;

(v) the text of adaptation (a) is replaced by the following:

‘ Specific case Norway (‘T0’)

This specific case is applicable for units operated on lines with non-upgraded catenary system. Lines with TSI compliant catenary system are indicated in the network statement.

The pantograph head geometry shall be according to EN 50367:2020+A1:2022, Annex B.3 figure B.5 (1 800 mm).’.

The following indent is added in points 37dn (Commission Regulation (EU) No 1301/2014), 37ma (Commission Regulation (EU) No 1300/2014), 37n (Commission Regulation (EU) No 321/2013) and 37o (Commission Regulation (EU) No 1299/2014):

‘—

32023 R 1694 : Commission Implementing Regulation (EU) 2023/1694 of 10 August 2023 ( OJ L 222, 8.9.2023, p. 88 ).’.

The following point is inserted after point 37ib (Commission Implementing Regulation (EU) 2017/6):

‘37ic.

32023 R 1695 : Commission Implementing Regulation (EU) 2023/1695 of 10 August 2023 on the technical specification for interoperability relating to the control-command and signalling subsystems of the rail system in the European Union and repealing Regulation (EU) 2016/919 ( OJ L 222, 8.9.2023, p. 380 )’.

The following is added in point 37pe (Commission Implementing Regulation (EU) 2019/777):

‘, as amended by:

— 32023 R 1694 : Commission Implementing Regulation (EU) 2023/1694 of 10 August 2023 ( OJ L 222, 8.9.2023, p. 88 ).’.

Article 2

The texts of Implementing Regulations (EU) 2023/1694 and (EU) 2023/1695 and Implementing Decision (EU) 2023/1696 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 15 March 2025, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
