DECISION OF THE EEA JOINT COMMITTEE No 30/2025

of 7 February 2025

amending Annex XIII (Transport) to the EEA Agreement [2025/732]

THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,
Whereas:
(1) Directive (EU) 2015/413 of the European Parliament and of the Council of 11 March 2015 facilitating cross-border exchange of information on road-safety-related traffic offences  ( 1 ) is to be incorporated into the EEA Agreement.
(2) Directive (EU) 2015/413 contains provisions with references to acts adopted under Title V TFEU. It is recalled that the incorporation of acts with such provisions into the EEA Agreement is without prejudice to the understanding that EU legislation adopted pursuant to Title V TFEU falls outside the scope of the EEA Agreement. The Contracting Parties are committed to comply with the obligation to implement Directive (EU) 2015/413, including the procedures necessary to enable the data exchanges in Article 4 referring to the Annex establishing such procedures as a result of the application of Council Decision 2008/616/JHA.
(3) With regard to the references in Article 4 of Directive (EU) 2015/413 to Council Decision 2008/616/JHA, the national procedures in the EFTA States are in accordance with the Agreement between the European Union and Iceland and Norway on the application of certain provisions of Council Decision 2008/615/JHA on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime and Council Decision 2008/616/JHA on the implementation of Decision 2008/615/JHA on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime and the Agreement between the European Union and the Principality of Liechtenstein on the application of certain provisions of Council Decision 2008/615/JHA on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime, of Council Decision 2008/616/JHA on the implementation of Decision 2008/615/JHA on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime, and the Annex thereto, and of Council Framework Decision 2009/905/JHA on accreditation of forensic service providers carrying out laboratory activities.
(4) Annex XIII to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:

Article 1

The following point is inserted after point 17kh (Commission Delegated Regulation (EU) 2017/1926) of Annex XIII to the EEA Agreement:
‘17l.
32015 L 0413 : Directive (EU) 2015/413 of the European Parliament and of the Council of 11 March 2015 facilitating cross-border exchange of information on road-safety-related traffic offences ( OJ L 68, 13.3.2015, p. 9 ).
The provisions of the Directive shall, for the purpose of this Agreement, be read with the following adaptations:
(a) As regards Iceland and Norway, the references to the procedures for information exchange in Article 4 established as a result of the application of Council Decision 2008/616/JHA in the Annex to that Decision shall be understood as referring to the procedures rendered applicable pursuant to Article 1 of the Agreement between the European Union and Iceland and Norway on the application of certain provisions of Council Decision 2008/615/JHA on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime and Council Decision 2008/616/JHA on the implementation of Decision 2008/615/JHA on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime.
As regards Liechtenstein, the references to the procedures for information exchange in Article 4 established as a result of the application of Council Decision 2008/616/JHA in the Annex to that Decision shall be understood as referring to the procedures rendered applicable pursuant to Article 1 of the Agreement between the European Union and the Principality of Liechtenstein on the application of certain provisions of Council Decision 2008/615/JHA on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime, of Council Decision 2008/616/JHA on the implementation of Decision 2008/615/JHA on the stepping up of cross-border cooperation, particularly in combating terrorism and cross-border crime, and the Annex thereto, and of Council Framework Decision 2009/905/JHA on accreditation of forensic service providers carrying out laboratory activities.
(b) In Article 12, the following subparagraph shall be added:
“By way of derogation from the first subparagraph, the EFTA States may postpone the deadline for transposition until six months after the entry into force of the Decision of the EEA Joint Committee No 30/2025 of 7 February 2025.”.’

Article 2

The text of Directive (EU) 2015/413 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 8 February 2025, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
