DECISION OF THE EEA JOINT COMMITTEE No 10/2025

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2025/747]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2024/950 of 15 January 2024 amending Delegated Regulation (EU) 2019/1602 as regards the date of application and the cases where customs authorities are required to deduct the quantities stated in the customs declaration from the total allowed quantity declared in the Common Health Entry Document (CHED) ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Delegated Regulation (EU) 2024/2562 of 3 June 2024 amending Delegated Regulation (EU) 2022/1644 as regards certain criteria for the selection of samples ( 2 ) is to be incorporated into the EEA Agreement.

(3) This Decision concerns legislation containing provisions regarding plant health. Legislation regarding plant health falls outside the scope of the EEA Agreement and provisions regarding plant health shall therefore not apply to the EFTA States.

(4) This Decision concerns, inter alia, legislation regarding live animals other than fish and aquaculture animals. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement.

(5) This Decision concerns legislation regarding veterinary matters, feedingstuffs and foodstuffs. Legislation regarding veterinary matters, feedingstuffs and foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(6) Annexes I and II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex I to the EEA Agreement shall be amended as follows:

The following is added in point 11bb (Commission Delegated Regulation (EU) 2019/1602) of Part 1.1 of Chapter I:

‘, as amended by:

— 32024 R 0950 : Commission Delegated Regulation (EU) 2024/950 of 15 January 2024 ( OJ L, 2024/950, 26.3.2024 ).’

The following is added in point 11h (Commission Delegated Regulation (EU) 2022/1644) of Part 1.1 of Chapter I:

— 32024 R 2562 : Commission Delegated Regulation (EU) 2024/2562 of 3 June 2024 ( OJ L, 2024/2562, 27.9.2024 ).’

The following is added in point 31qb (Commission Delegated Regulation (EU) 2019/1602) of Chapter II:

‘, as amended by:

— 32024 R 0950 : Commission Delegated Regulation (EU) 2024/950 of 15 January 2024 ( OJ L, 2024/950, 26.3.2024 ).’

The following is added in point 31w (Commission Delegated Regulation (EU) 2022/1644) of Chapter II:

‘, as amended by:

— 32024 R 2562 : Commission Delegated Regulation (EU) 2024/2562 of 3 June 2024 ( OJ L, 2024/2562, 27.9.2024 ).’

Article 2

Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

The following is added in point 164b (Commission Delegated Regulation (EU) 2019/1602):

‘, as amended by:

— 32024 R 0950 : Commission Delegated Regulation (EU) 2024/950 of 15 January 2024 ( OJ L, 2024/950, 26.3.2024 ).’

The following is added in point 164ze (Commission Delegated Regulation (EU) 2022/1644):

‘, as amended by:

— 32024 R 2562 : Commission Delegated Regulation (EU) 2024/2562 of 3 June 2024 ( OJ L, 2024/2562, 27.9.2024 ).’

Article 3

The texts of Delegated Regulations (EU) 2024/950 and (EU) 2024/2562 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 4

This Decision shall enter into force on 8 February 2025, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
