DECISION OF THE EEA JOINT COMMITTEE

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,
Whereas:
(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 115/2011 of 21 October 2011(1).
(2) Commission Regulation (EU) No 998/2010 of 5 November 2010 concerning the authorisation of
Enterococcus faecium
DSM 7134 as a feed additive for chickens for fattening (holder of the authorisation Lactosan GmbH & Co KG)(2) is to be incorporated into the Agreement.
(3) Commission Regulation (EU) No 999/2010 of 5 November 2010 concerning the authorisation of 6-phytase (EC 3.1.3.26) produced by
Aspergillus oryzae
(DSM 17594) as a feed additive for sows (holder of authorisation DSM Nutritional Products Ltd)(3) is to be incorporated into the Agreement.
(4) Commission Regulation (EU) No 1070/2010 of 22 November 2010 amending Directive 2008/38/EC by adding to the list of intended uses as a particular nutritional purpose the support of the metabolism of the joints in the case of osteoarthritis in dogs and cats(4) is to be incorporated into the Agreement.
(5) Commission Regulation (EU) No 1117/2010 of 2 December 2010 concerning the authorisation of a preparation of citric acid, sorbic acid, thymol and vanillin as a feed additive for weaned piglets (holder of the authorisation Vetagro SpA)(5) is to be incorporated into the Agreement.
(6) Commission Regulation (EU) No 1118/2010 of 2 December 2010 concerning the authorisation of diclazuril as a feed additive for chickens for fattening (holder of authorisation Janssen Pharmaceutica NV) and amending Regulation (EC) No 2430/1999(6) is to be incorporated into the Agreement.
(7) Commission Regulation (EU) No 1119/2010 of 2 December 2010 concerning the authorisation of
Saccharomyces cerevisiae
MUCL 39885 as a feed additive for dairy cows and horses and amending Regulation (EC) No 1520/2007 (holder of the authorisation Prosol SpA)(7) is to be incorporated into the Agreement.
(8) Commission Regulation (EU) No 1120/2010 of 2 December 2010 concerning the authorisation of
Pediococcus acidilactici
CNCM MA 18/5M as a feed additive for weaned piglets (holder of the authorisation Lallemand SAS)(8) is to be incorporated into the Agreement.
(9) Commission Regulation (EU) No 168/2011 of 23 February 2011 amending Regulation (EU) No 107/2010 as regards the use of the feed additive
Bacillus subtilis
ATCC PTA-6737 in feed containing maduramycin ammonium, monensin sodium, narasin, or robenidine hydrochloride(9) is to be incorporated into the Agreement.
(10) This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I. This Decision is therefore not to apply to Liechtenstein,
HAS ADOPTED THIS DECISION:
Article 1
Chapter II of Annex I to the Agreement shall be amended as follows:
(1) the following indent shall be added in point 1k (Commission Regulation (EC) No 2430/1999):

Article 2
The texts of Regulations (EU) No 998/2010, (EU) No 999/2010, (EU) No 1070/2010, (EU) No 1117/2010, (EU) No 1118/2010, (EU) No 1119/2010, (EU) No 1120/2010 and (EU) No 168/2011 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the
Official Journal of the European Union
, shall be authentic.
Article 3
This Decision shall enter into force on 3 December 2011, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(10).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the
Official Journal of the European Union
