DECISION OF THE EEA JOINT COMMITTEE No 169/2026

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2026/2007]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2026/373 of 20 February 2026 approving formaldehyde released from the reaction products of paraformaldehyde and 2-hydroxypropylamine (ratio 1:1) as an existing active substance for use in biocidal products of product-types 2, 11 and 13 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2026/385 of 20 February 2026 approving formaldehyde released from the reaction products of paraformaldehyde and 2-hydroxypropylamine (ratio 3:2) as an existing active substance for use in biocidal products of product-types 2, 6, 11, 12 and 13 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 2 ) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2026/377 of 20 February 2026 postponing the expiry date of the approval of Bacillus sphaericus 2362 serotype H5a5b, strain ABTS1743 for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( 3 ) is to be incorporated into the EEA Agreement.

(4) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following points are inserted after point 12nnnl (Commission Implementing Decision (EU) 2025/2344) of Chapter XV of Annex II to the EEA Agreement:

32026 R 0385 : Commission Implementing Regulation (EU) 2026/385 of 20 February 2026 approving formaldehyde released from the reaction products of paraformaldehyde and 2-hydroxypropylamine (ratio 3:2) as an existing active substance for use in biocidal products of product-types 2, 6, 11, 12 and 13 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( OJ L, 2026/385, 23.2.2026 ).

32026 D 0377 : Commission Implementing Decision (EU) 2026/377 of 20 February 2026 postponing the expiry date of the approval of Bacillus sphaericus 2362 serotype H5a5b, strain ABTS1743 for use in biocidal products of product-type 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council ( OJ L, 2026/377, 23.2.2026 ).’

Article 2

The texts of Implementing Regulations (EU) 2026/373 and (EU) 2026/385 and Implementing Decision (EU) 2026/377 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 6 June 2026, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
